YANKTON, SD — Two state prisoners were placed on escape status after failing to report to work.
35-year old Benjamin Johnson and 34-year old Lalo Montoya were reported missing after failing to report following an appointment with their work release employers.
Johnson was serving a five year sentence for unauthorized ingestion of a controlled substance. Montoya was serving a five year sentence on drug charges.
Escape procedures were enacted and Montoya was taken into custody at a Yankton residence Saturday.
According to South Dakota law any person who fails to return to custody following temporary leave is a class 5 felony and is punishable by a maximum of five years in prison.
As of Saturday both inmates were back in custody.
