NORFOLK — Attorneys presented, councilmen debated and the mayor played mediator but still, nothing is official regarding the proposed Majestic Lake housing development.
The Norfolk City Council passed an amended version of a Final Planned Development for Majestic Lake on first reading as part of a three and a half hour meeting on Monday night. But, they declined to hear the proposal on second and third readings.
The development is a proposed 160-acre subdivision one half mile south of Omaha Avenue and 25th Street. The controversy stems from which major road is used to access the subdivision. Developers originally wanted access to 25th street, but after Vulcraft expressed resistance to the idea, the developers shifted their plans to use 37th street as the access point.
Attorney representing the developers Tim Brogan says the concession by the developers is a sign they are willing to work with the industries in the area.
“Folks didn’t get everything here, our clients certainly didn’t,” Brogan said. “Vulcraft got what they wanted and now they want one more thing. No. Everybody conceded on certain points, we’re done, this is a good housing development. It is time to pass this thing.”
But Vulcraft, represented by attorney Luke Henderson, argued just putting a 37th street access in the plan wasn’t enough. He expressed concern that there was nothing specific preventing the developers from building a road connecting to 25th in the future.
Councilmen Gary Jackson and Jim Lange agreed. Lange proposed an amendment to the plan to specify an access could only be built to 37th street.
The Council split 4-4 on the vote and Mayor Josh Moenning broke the tie with a no vote.
Next, he recommended adding language stipulating a change in the access point would have to be brought before the City Council for approval.
Lange then proposed the mayor’s recommended amendment and it passed 6-2. The developers said they disagreed with both amendments. Brogan said it is likely they would withdraw the amended plan before it was passed on second and third reading, thus starting the process over again.
The council went on to table resolutions and ordinances related to the development.
The Final Planned Development will be scheduled for second reading on November 20th unless it is withdrawn before that time.
