Sidney man charged with terroristic threats, assault has case bound to district court
SIDNEY, NE - A Sidney man facing multiple assault charges has had multiple cases bound over to district court.
According to court documents, 41-year-old Toby Marx is facing charges in Cheyenne and Red Willow counties.
Marx is charged with two counts of misdemeanor domestic assault and one count of terroristic threats, a Class 3 felony in Cheyenne County.
Marx was arrested in late December after Sidney police were called to a report of a domestic dispute. While investigating that incident, police discovered Marx had a warrant out for his arrest for a misdemeanor assault from in early December.
The incident in late December added the other misdemeanor and felony charges.
The victim was the same person in both incidents. At a hearing in late December, Marx signed a bond agreement saying he wouldn't have any more contact with the victim or commit any crimes.
Then on January 31, Marx was arrested in Red Willow County. Court documents show that Marx was staying in a hotel with the same woman from the previous incidents.
When police arrived, the victim had noticeable bruises and marks. Marx was charged with misdemeanor domestic assault and felony assault by strangulation.
As a result of his arrest in Red Willow County, Marx had contempt of court added to his charges in Cheyenne County.
Marx's Red Willow case was bound to district court on February 20. The Cheyenne County case from the incident in late December was bound over Monday.
Arraignment is scheduled for Marx on his contempt charge on March 9.
A jury trial for the initial assault charge from early December scheduled for May 19. Marx has pleaded not guilty in that case.
