The first-degree murder trial of Bailey Boswell is underway in Dawson County. A jury will decide if Boswell is guilty of killing and dismembering Sydney Loofe.

Boswell's co-defendant, Aubrey Trail, was convicted of the same charge last July in a highly publicized trial.

Crete attorney David Solheim followed those proceedings closely. He says Boswell's defense team can take a couple different approaches.

"Does she say, 'I'm innocent of this crime, I had nothing to do with it, I was just kind of an unwitting participant in some of these other tangential activities.' Or does she just deny all culpability altogether and say, 'hey, listen, I wasn't a part of this and you've got the wrong person altogether.' She's got some decisions to make as to how all that goes."

The Trail trial has already affected the Boswell trial. Judge Vicky Johnson granted a relocation request that changed the venue from Saline County to Dawson County.

Solheim says there could be more carryover from the first trial. He says both sides will be looking for any changes in witness testimony.

“I think the consistency of the witness testimony, given all the time that’s passed… I think those differences in witness testimony could be an X factor here that doesn’t normally happen in a single-person criminal trial,” Solheim said.

It’s unclear exactly how long jury selection will take but it’s expected to last at least all of Wednesday. Judge Johnson has set aside three weeks for the trial.
